When a parent is going through a divorce, he or she will most likely have immediate concerns and questions regarding the care and custody of the children. It is also very likely that the other parent will have similar concerns and questions. Mr. De La Garza strives to help his clients, whenever possible, resolve child custody issues outside of court through collaboration and/or mediation. However, when litigation is necessary, he will proceed diligently and vigorously on behalf of his client.
Other Primary Practice Areas:
Probate Law (Wills, Estates & Trusts)
The Attorney General’s office of the State of Texas has built within its agency several units that deal exclusively with Child Support matters, including setting present child support based on income, modification of child support amounts, enforcement of prior child support orders for back child support, and health insurance matters including Medicaid and CHIPS (Children’s Health Insurance Program). However, not all of these issues can be easily handled through the website or through dealings with this agency at the several offices across Texas. Many times, these cases require the help of private attorneys to assist the agency in its efforts to set and modify child support, to help clients navigate their cases through the Attorney General’s Child Support Review Process, and more importantly, to assist them in navigating through the courts that handle these cases.
Sometimes following a divorce, significant life changes can make the original child custody agreement or judgment unfair or in some circumstances, impossible. If this situation applies to you, Mr. De La Garza can help you file a motion for a modification of the original divorce, child support, custody or Attorney General order, whether that order was agreed to or decided by a judge. He will listen closely to your concerns and represent your best interests during all negotiations and courtroom hearings.
